Probate Costs
The rates are
Senior Solicitors (10+ years experience) – £175 p/h
Junior Solicitors (<10 years experience) – £150 p/h
Trainee Solicitors/Paralegals – £90 p/h

For Probate Matters we charge for work done at an hourly rate depending upon the experience of the Fee Earner dealing with your case. We do not charge a percentage of the estate so the value of the estate does not affect our prices. The amount of work needed is not necessarily directly related to the value of the estate and so we feel this is the fairest way to charge you.

Should a dispute arise over the estate, this is not dealt with as part of the probate matter. However, our litigation department has considerable experience and would be able to assist. Again we are happy to work with a different firm if you prefer. This is only if there is a serious dispute such as contesting the will.

Probate matters can differ greatly in time scales and work done depending on individual circumstances so it is difficult to give a general idea of either without talking to you about the specifics of the estate. However, there are key factors involved in most probates that we can use to give some indication of time. For a simple estate the average time is 3 – 6 months and our average fee, excluding VAT, is in the region of £2,000.
Disbursements
Disbursements are costs relating to your matter that are payable to third parties such as the fee for obtaining a grant of Probate. We will handle payment of such fees as part of our service but they do not form part of our fees. Such likely disbursements are:
• Probate/Letters of Administration Application Fee £300
• Swearing an oath £5-£10 per executor
• Copies of the Grant of Probate/Letters of Administration £1:50 per copy (usually need 1 per asset)
If you are unable to find a Will, we can search the National Will Register for you
• Certainty Will Search £114
Key stages
• Obtaining the Grant of Probate – 1-2 weeks
• Investigating if Tax on the estate is due and paying ~4 weeks
• Distribution of assets – 1-2 weeks
• Drafting Documents to apply for Probate – 1-2 weeks
• Collecting in assets – 2-3 weeks
• Sale of property – 6-8 weeks from accepting offer
